1. Acceptance of Terms

By accessing or using picbanao.com (the "Site") and the services we offer, you agree to comply with and be bound by these Terms of Service. If you do not agree to these terms, please do not use the Site.

2. Eligibility & Age Requirements

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to create an account, purchase Wallet credits, or activate a Subscription. By using the Site, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

PicBanao is an AI image generation platform and open visual studio providing curated prompt blueprints, cinematic configuration charts, and on-demand cloud visual creation tools.

4. Subscriptions & Wallet Credits

We offer a Wallet system to fund your generative AI usage:

• Purchases: All purchases of Wallet credits or Pro/Ultra subscriptions are final.
• No Refunds: Because AI image generation immediately consumes irreversible computing resources (GPUs), we cannot offer refunds for credits used or subscriptions activated.
• Queue Priority: Generation speed is dependent on your tier. Pro and Ultra users receive priority queue access.

5. Intellectual Property & Usage Rights

The rights to the images you generate depend on your subscription tier:

• Free Tier: You are granted a license for Personal Usage Rights only. You may not sell or use the images for commercial gain.
• Pro & Ultra Tiers: You are granted Commercial Usage Rights. You own the outputs you generate to the maximum extent permitted by current AI copyright laws in your jurisdiction.
• Your Input Data: If you upload reference images for generation, you represent and warrant that you own or have the necessary licenses for those images. You retain all ownership of your inputs.
• Copyright Disclaimer: Due to evolving international laws regarding AI-generated art, we cannot guarantee the copyrightability of any generated image.

6. Acceptable Use Policy (AUP)

You agree not to use our generation tools or the Site to:

• Generate Child Sexual Abuse Material (CSAM), non-consensual intimate imagery, or deepfakes.
• Generate hate speech, targeted harassment, or violence.
• Infringe on the copyrights or trademarks of third parties.
• Initiate automated web scraping or data extraction scripts.
• Strip, alter, or remove AI metadata, C2PA credentials, or watermarks from generated images to bypass EU AI Act transparency requirements.

We utilize automated safety filters. Violation of this AUP will result in immediate account termination without refund.

7. Disclaimers & No Warranty

The prompt blueprints and visual generation tools are provided on an **"as-is"** and **"as-available"** basis. We make no warranty that:

• The AI models will produce identical or specific visual outputs, as AI rendering is highly stochastic.
• The third-party GPU providers we rely on will operate uninterrupted or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, PicBanao and its developers shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use or inability to use the platform, including any third-party copyright claims against your generated images.

9. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or your use of the platform shall be subject to the exclusive jurisdiction of the courts of India.

10. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be posted to this page with an updated "Last Updated" timestamp. Continued use of the Site signifies acceptance of the revised Terms.
